The doubt about whether Social Security covers the health expenses of a traffic accident and whether it should be the insurers that must manage it is logical.
The so-called healing expenses, which can also be referred to as health care expenses as a result of suffering a traffic accident, are not covered by Social Security.
However, this does not mean that they do not have any type of coverage. In this sense, it is the insurance companies that are in charge of attending to the medical expenses suffered by the people who are involved in an accident. Pedestrians, passengers, other drivers enter here… In short, it is the insurance that takes care of all the victims.
On this matter, as confirmed by Tráfico Ayuda, the resolution of traffic accidents in our country is managed through the Spanish Union of Insurance and Reinsurance Entities (UNESPA). This body signs, together with the Insurance Compensation Consortium, several health agreements with public and private centers.
In this way, agreements are signed with hospitals, clinics and physiotherapy centers where the necessary medical attention is provided and rehabilitation treatments are carried out on the injured person. Currently, the agreements in force are the following:
– Medical assistance in the public sector: with it the entire network of hospitals that is in charge of the State is covered. This includes emergency care, hospitalization, rehabilitation and medical transfers.
Here, the company is billed for services provided in almost the entire national territory. The only exceptions are Navarra and the Valencian Community, where they are carried out through modules.
– Medical assistance in the private sector: it does not have great differences with respect to the public sector. However, the entire private healthcare network is not included, but only those groups, hospitals or clinics expressly affiliated.
– Health emergencies: this includes the entire public health emergency network, both for land and air means.
– Agreement with SAMUR: this is an agreement only for the municipal area of Madrid. The first expenses that are generated are usually those of the immediate attention after the accident and, within this agreement, two types of assistance are included in the event of an accident.
On the one hand, there is the assistance of SAMUR personnel at the place where the accident occurred. Likewise, emergency assistance from a hospital in the municipality is also added.
With this, it must be borne in mind that the insurer of the vehicle responsible for causing the accident will be responsible for all the costs incurred.
However, what would happen if the vehicle at fault did not have insurance? In that case, there is also a way for health expenses. Specifically, the Insurance Compensation Consortium will be in charge of assuming all the expenses derived from the accident.
Finally, in the event of an event of these characteristics, we must know that the insurer is obliged to inform the injured party of their right to free choice of the medical center in which rehabilitation treatment for their injuries can be carried out.
