A new victory for LaLiga

As we tell you, LaLiga has achieved another ruling this week in its favor in its fight against IPTV Pirates. On this occasion, the victory was against the website iptvplaystar.com, through which a television service was marketed through IPTV, providing m3u lists. These lists allowed users to access the viewing of protected content such as LaLiga matches, obviously lacking the authorization or license of their owners.

The oral hearing of this process has been held in the Criminal Court No. 13 of Madrid, and in it the administrator of this website recognized the alleged facts and agreed with the accusation. Specifically, he has been sentenced for criminal code crimes against the market and consumers (article 286) and against intellectual property (article 270).

The sentence issued by this Criminal Court condemned the administrator of iptvplaystar.com to a prison sentence of one year and six months, added to the penalty of a fine of 16 months at the rate of a daily fee of 5 euros, with criminal responsibility subsidiary of one day of deprivation of liberty for every two unpaid installments of this fine. In addition, apart from completely eliminating access to the web page related to the events, the administrator has been sentenced to special disqualification from carrying out any type of activity related to the creation and management of web pages, as well as the administration of servers and hosting. and the sale of electronic products during the time of the sentence.

As if this were not enough, the court has also sentenced this web administrator to pay 5,436.68 euros to LaLiga and Mediapro, in addition to the costs of the entire legal process, which amount to 1,800 euros.

Pioneer precautionary measures

The sentence that we commented on just a little above is added to other precautionary measures that LaLiga obtained in the Court of First Instance and Instruction No. 1 of Cieza. These precautionary measures taken against a well-known app that also provided access to pirated football through m3u lists are pioneering for LaLiga and for intellectual property in general, and may set a precedent for future processes.

These measures taken by the Court were the following: The withdrawal of the application from the virtual stores or stores of the main mobile application providers; disabling or preventing users of these stores who have downloaded the app from accessing the application, and immediately ceasing the payment of commissions earned from downloading the paid version of this application whose name LaLiga did not want to provide .
