New requirements for holders of personal mobility vehicles (VMP)

Currently, the exponential increase in the use of electric scooters in our cities is a reality that is unfortunately translating into a higher accident rate.

Given this situation, and although always late, the legislator has initiated the regulation of this type of vehicle, the last published being the Resolution of January 12, 2022 of the DGT, which approves the Manual of characteristics with the new requirements for holders of personal mobility vehicles (VMP).

The aforementioned manual serves as an obligatory guide to know in detail the technical requirements that personal mobility vehicles must meet for their entry into circulation, their classification, the testing processes for their certification and the mechanisms that will be used for their easy ID.

Let us remember the conditions that are established for its use from now on, some of which were already regulated:

– The maximum speed allowed is 25 km/h.

– It is necessary to present a technical file where it is shown that it follows the standards, with the manufacturer’s specifications.

– The helmet is still mandatory.

– Driving on sidewalks, pedestrian areas, crossings, interurban roads, highways and expressways or urban tunnels is prohibited.

The main novelty, according to what Fernando Millán Solera, a lawyer for Traficoayuda, tells us, is that as of January 22, 2024, all VMPs that are marketed must have a circulation certificate.

Compulsory certificate for scooters: we already have a date

But what is a circulation certificate? A document that determines the technical characteristics that the VMP must meet to circulate on public roads, in order to be certified and regulated by the competent bodies.

In addition, they will have to carry -in a visible place- a plate where they will be shown: maximum speed, manufacturer, serial number, year of manufacture or commercial name.

However, the certificate that must be attached to the sale will not be mandatory until January 24, 2024 and vehicles purchased before that date will be able to circulate until January 24, 2027.

Where can it be found? If you have just purchased a new scooter, it is the manufacturer himself who is in charge of providing it for sale. If, on the other hand, you already have a scooter, you must personally request said certificate from the manufacturer where the characteristics required by the regulations to be able to circulate on public roads are reflected.

If these types of characteristics are already being regulated, is it likely that VMP will be made mandatory in the future?

Currently, this obligation does not exist, as they are not considered motor vehicles, with the exception of rental companies. But it must be taken into account that when a VMP is not insured and causes damage to a third party, resulting in the driver being responsible, the future compensation must be borne by the personal assets of the driver or owner.

Although this is currently the case, the need for compulsory insurance is becoming ever closer. We are facing a situation of illegality, that is, of lack of regulation and that is only approximately and by similarity is on many occasions equated to the use of bicycles.
