The new General Telecommunications Law approved in 2022 entails changes in the rights of users, in the relationship with companies and operators… But, do we have to notify a month before to unsubscribe? This is what the law says and this is what you must take into account from now on to unsubscribe.
To know how to unsubscribe from our operator we can read it in the small print of each of them. They all have something in common and that is that they require a minimum advance notice both to process a cancellation and for portability and this is reflected in the legal conditions of any company if you take a look at your contract or the legal section of the website. But this can change with the new General Telecommunications Law and each one will decide what to do.
With the new General Telecommunications Law, changes are introduced in the relationship between operators and customers and now that it comes into force we must take into account that the text will adapt the regulations in Spain so that it resembles as much as possible what is required in Europe, with common standards in all countries.
Maximum stays
The first thing we have to take into account is that the new norm, adapting to what is required by Europe, will be in charge of regulating and controlling the permanence. Although it is very frequent since we contract operators that give us freedom and do not offer us permanence, these types of contracts continue to exist and are quite frequent.
Now, the new LGT will limit maximum stays to 24 months. No company or operator can stay for more than two years. As we read in the OCU, “the rule establishes that after 24 months, contracts are automatically extended, but users have the right to terminate them at any time.” Even so, they explain, “after this period, they will not be able to apply any penalty for cancellation.” That is, you can leave whenever you want.
Advance notice
Another of the changes that we read in the new law is related to the notice to request withdrawal. Although you may not know it, the marketers were obliged to only 48 hours to attend to contract requests. Also in the case of portability requests there were a maximum of two days for it.
But now, with the new law, this changes. Operators may require us to give a total of 30 days notice to terminate the contract. It will not be mandatory, but companies can choose whether or not to apply it. In other words, the law indicates that it is an option to require this notice, but it will be each operator independently who decides whether to add it to their legal conditions or not.
As they collect from the OCU, some operators such as Orange or Vodafone have already indicated that they will not apply this notice and it will not be necessary to notify a month before to terminate the contract but you should review the legal conditions of each company since now this can change and It is important to know what the one we have contracted offers or what is required.
