Does teleworking really work? This method of working has its advantages, but some companies are reluctant to implement teleworking. This is what an employee has experienced who has been fired by court order for not performing well enough from home to carry out all of his tasks. Nowadays, remote work is very common in some companies in order to facilitate the relationship between worker and company and make everything more comfortable to carry out those functions that do not require an in-person event. In fact, the pandemic fueled the rise of teleworking back in 2020, such that it is a practice that has been imposed in many departments. But, we enter into the usual controversy: is it productive to telework from home? Although teleworking can have many advantages, it is not always favorable for companies. Let’s look at this specific case.
Dismissal due to failure to comply with schedules
An employee belonging to the sales company Salesland was dismissed in 2022 in a disciplined manner by order of a judge due to his poor performance from the workplace he occupied at home. A computer expert has corroborated this after observing that the worker was not at his workplace during his stipulated working hours, in such a way that he even disappeared for up to two full days, abandoning his duties of responsibility. According to the magistrate, these are very serious breaches reflected in the articles of the Collective Agreement at the state level of the Contact Center sector.
The sentence also ratifies disloyalty, falsehood, fraud, abuse of trust and theft or theft from both other co-workers and the company itself, breaking an employment relationship that has lasted more than ten years. Based on this, although at first the Social Court number 47 of Madrid imposed a compensation of 19,000 euros presented by the worker, the truth is that the TSJ of Madrid has rejected the appeal, putting forward the supplication of the company and alleging that it is fair dismissal.
Is teleworking counterproductive?
At this point, we must discern between several specific cases of companies that, unfortunately, have employees to whom they give their full trust and cannot be reciprocated. But it’s not always like this. Teleworking can be agreed between the company and the worker as long as there is agreement between both parties, although it is also a right for the employee himself in extreme situations, either because you are going to live in another city or because you do not have any means to go to work in person. But mainly this right is required to comply with family conciliation.
Be that as it may, teleworking offers many other benefits between company and worker, for example cost savings by avoiding travel and reducing carbon emissions, optimization and management of working time or greater comfort when working in an environment more personal, among others.
