Judge invalidates a speeding ticket because three vehicles appeared in the photo

Fines for speeding are one of the most recurring in Spain according to data from the DGT. However, they are not always valid and there are small loopholes that allow you to resort to them in case you find an error or that they contain contradictory information. And this is what has recently happened in the Madrid Contentious-Administrative Court.

A judge has invalidated a speeding ticket because three vehicles appeared in the photo. And it is that the image is a very important element for speeding tickets, they point out from Pyramid Consulting, and this must have quality and show the offender accurately.

The fine was imposed by the Madrid City Council and three vehicles could be seen in the image. In this case, the Judge understood that, due to the proximity of the vehicles, serious doubts would be generated with respect to which vehicle the speed captured by the radar referred to.

Given the doubt about which of the three vehicles was the one that exceeded the speed limit, the Judge decided to annul the speeding fine and cancel any sanction attributed to it.

For the image that captures suspected traffic violations due to excessive speed to be valid, it must be clear with a view to clearly identifying the vehicle and must be accurate with the speed captured.

As stated in Article 1.12 of Order ICT 155/2020: “When two or more vehicles with different speeds simultaneously enter the measurement field, the kinemometer must not give a speed reading unless it is capable of detecting, following and identifying unequivocally the objectives throughout the measurement process.
